Persons entering MSWA Ocean Ride must agree to the following TERMS & CONDITIONS:

Binding Terms

These Terms and Conditions of Entry as published on the website http://oceanrideforms.org.au/ as amended from time to time (Terms) govern the terms of your participation in the MSWA Ocean Ride event (Event) operated by MSWA ABN 75 638 080 972. 

By registering to participate in the Event you will be assumed to have read, and agreed to be bound by these Terms.  If an entrant is a mixed Team or a Family Team which consists of more than one person, these Terms bind each team member separately.

Entrants

For the purpose of these Terms, the term ‘you’ means each entrant that is part of a Mixed Team, a Family Team or an Individual as the case may be.

  1. Mixed Team
    1. A Mixed Team can comprise of unlimited numbers.
    2. Only one team member is required to enter the Event on behalf of all team members. That team member must have the consent of each team member to provide the personal details of each team member to MSWA for the purposes of completing the required entry forms.
    3. If you are entering the Event on behalf of another person, you are assumed to be the agent of the entrant and you are deemed to have accepted the Terms on the entrant’s behalf. It is your responsibility to ensure each team member has read and understood these Terms.
  2. Family Team
    1. A Family Team can comprise of up to 2 adults and 3 children. A child is any person under the age of 18.
    2. Only one family member is required to enter on behalf of the Family Team. That team member must be the parent and/or legal guardian of the children in the Family Team. 
    3. If a team member is under the age of 18 (Minor), you certify that:
      1. the Minor has the express consent of their parent(s) and/or legal guardian(s) to participate in the Event and you agree that MSWA reserves the right to request evidence of such consent at any time before, during or after the Event;
      2. The parent(s) and/or legal guardian(s) accepts these Terms on behalf of the Minor; and
      3. the Minor will be accompanied by an adult for the duration of the Event.
    4. If you are entering the Event on behalf of another person, you are assumed to be the agent of the entrant and you are deemed to have accepted the Terms on the entrant’s behalf. It is your responsibility to ensure each team member has read and understood these Terms.
  3. Individuals
    1. An Individual entrant must be 18 years or older.
    2. The Individual entrant must complete the required entry forms.

Acknowledgements

You understand and agree that:

  1. in consideration of, and as a condition of acceptance of your entry in the Event for yourself, your dependents,  your heirs, executors and / or administrators, you hereby waive all and any claim, right or cause of action which you might otherwise have arising out of your death, injury, damage, or loss of any description (including, but not limited to consequential loss such as loss of business, loss of profits and loss of opportunity) whatsoever that you may suffer or sustain or any other person suffers or sustains, in the course of, or consequent to your entry and/or participation in the Event;

You fully release MSWA and indemnify and forever agree to keep MSWA indemnifiedagainst any charges, claims, costs, losses, expense or liability for any negligent or tortious act or omission, breach of duty, breach of contract or breach of statutory duty arisingout of any act or omission of MSWA or its agents, contractors, representatives, officers or employees;

  1. By entering the Event you agree and consent to receiving and reviewing   all information provided to you about the Event, which will primarily be via email to the email address you provide at the time of entering. Updated information will be posted on the event website at http://oceanrideforms.org.au/  and the MSWA Ocean Ride Facebook page from time to time and you agree to regularly check these pages for updates.
  2. This waiver, release and discharge shall be (and operate separately) in favour of all persons, corporations and bodies involved, or otherwise engaged in promotion or staging the Event and each of their servants, agents, representatives and officers.
  3. MSWA is not liable to you and does not insure you against any injuries or damage sustained as a result of  any accident that occurs as a result of your participation in the Event.
  4. To the extent permitted by law, the entry fee is not refundable if:
    1. you change your mind;
    2. are no longer able to participate in the Event;
    3.  you are denied access or removed from the Event for any reason; or
    4. the Event is delayed, hindered or cancelled as a result of force majeure, which expression shall mean any event beyond the reasonable control of MSWA and the Event organisers.
  5. Registrations are not transferable to another person or to a future event operated by MSWA.
  6. If you are not wearing a helmet, you will not be able to ride.
  7. The Event involves the real risk of injury or death from various causes including over exertion, accidents with competitors, vehicles or other road users and general public. Accordingly, you attest, verify and acknowledge that:

a) you have full knowledge and understanding of the nature and extent of all risks involved in participating in the Event;
b) you undertake to participate in the Event freely, voluntarily and absolutely at your own risk;
c) You have no physical or mental condition(s) which have the potential to put yourself or any other person at risk;
d) You are sufficiently trained and have sufficient fitness to participate in the Event;

e) You also acknowledge that the risk warning above constitutes a 'risk warning' in accordance with relevant legislation, including the Civil Liability Act 2002 (WA).

  1. You will  seek medical advice prior to participation in the Event if you have suffered, or are suffering from, any medical condition which may impact your ability to participate in the Event and you will have suitable food and/or any medication required with you at all times; and
  2. you will abide by the Rules and Safety Regulations attached to these Terms at all times.
  3. You are responsible for your personal belongings at all times during the Event. MSWA accepts no liability for any loss or damage to your personal belongings.
  4. To the extent permitted by law, the Event and your participation in the Event may be affected by weather and other associated conditions outside of the control of MSWA. You acknowledge these conditions are governed by chance and are not under the control of the Event organiser. MSWA will not be liable for any loss or damage in the event of poor weather before or during the event including the refund of your entry fee. .
  5. You are required to remit any sponsorship money or donations collected for or on your behalf associated with your participation in the Event to MSWA at the conclusion of the event without unreasonable delay.
  6. MSWA does not take responsibility for the condition, upkeep or maintenance of the course.
  7. It is possible for MSWA as a supplier of recreational services or recreational activities to ask you to agree that statutory guarantees under the Australian Consumer Law (which is Schedule 2 to the Competition and Consumer Act 2010 (Cth)) do not apply to you (or a person for whom or on whose behalf you are acquiring the services).
  8. By signing your membership application you will be agreeing that your rights (or the rights of a person for whom or on whose behalf you are acquiring the services) to sue the supplier in relation to recreational services or recreational activities that you undertake because the services or recreational activities provided were not in accordance with the guarantees are excluded, restricted or modified as set out below.
  9. You do not have to agree to exclude, restrict or modify your rights by signing your application form. MSWA may refuse to provide you with the services if you do not agree to exclude, restrict or modify your rights by signing your application form. Even if you sign this membership application form, you may still have further legal rights against MSWA.
  10. A child under the age of 18 cannot legally agree to exclude, restrict or modify his or her rights. A parent or guardian of a child who acquires recreational services for the child cannot legally agree to exclude, restrict or modify the child's rights.
  11. By signing your membership application you agree that the liability of MSWA in relation to recreational services (as that term is defined in the Competition and Consumer Act 2010 (Cth) and the Australian Consumer Law) and recreational activities (as that term is defined in the Civil Liability Act 2002 (NSW) and the Civil Liability Act 2002 (WA)) for any:
    1. death;
    2. physical or mental injury (including the aggravation, acceleration or recurrence of such an injury);
    3. the contraction, aggravation or acceleration of a disease;
    4. the coming into existence, the aggravation, acceleration or recurrence of any other condition, circumstance, occurrence, activity, form of behaviour, course of conduct or state of affairs:
      1. that is or may be harmful or disadvantageous to you or the community;
      2. that may result in harm or disadvantage to you or the community,

that may be suffered by you (or a person for whom or on whose behalf you are acquiring the services) resulting from the supply of recreational services or recreational activities is excluded and the application of any express or implied term that any services will be provided with due care and skill is hereby excluded.

Consents

By your entry and participation in the Event, you acknowledge and consent to:

  1. photographs being taken of you during your participation in the Event. You acknowledge that such photographs are owned by MSWA and that it may use the photographs for promotional or other purposes without your further consent;
  2. the Event organisers using your  name, image, likeness and your participation in the Event for promotional or other purposes at any time;
  3. receiving any medical treatment that the Event organisers or their authorised representatives consider necessary or desirable during or after the Event should you require such medical treatment Should you require ambulance transportation to hospital, this will be at your own expense.

The Event takes place on public roads that are open to general traffic (other than the Mundella 10km Family Ride which is on the designated bike path). Traffic management systems are in place along the course, these include marshals at intersections and roundabouts, lane closure along West Coast Highway, and directional signage. Participants must abide by all road rules and obey the direction of Police and traffic marshals.

Ride within the law: Standard road rules that apply to motorists also apply to cyclists. Police will be on the road and will fine those who:

  • do not wear a helmet;
  • disobey traffic lights at intersections and do not stop at pedestrian crossings;
  • fail to keep left;
  • ride more than two abreast;
  • ride in a dangerous manner or negligently; and
  • use mobile phones whilst riding.

Staying safe: For your safety and the safety of other cyclists, volunteers, and the general public please follow the safety tips below:

  • always wear your helmet when cycling;
  • no iPods or earphones allowed;
  • the use of mobile phones while riding is illegal so if you need to use your mobile phone please call ‘stopping’ and move off the road;
  • abide by the road rules and obey directions from Police, marshals, traffic controllers and event staff;
  • always ride with the traffic, on the left of the road;
  • use hand signals if turning left or right or stopping;
  • only pass to the right of another rider and call out ‘passing‘ when doing so;
  • riders should always look behind before pulling out to pass another rider;
  • your bike must be mechanically sound with both front and rear brakes in working order;
  • remember to drink plenty of water and eat healthy food before, during and after the ride;
  • it is your responsibility to download the course maps and GPX files and to follow the sign posted course; and
  • keep a look out for marshals alerting you to hazardous areas ahead.

 

 

MSWA OCEAN RIDE – PARTICIPANT RULES & CONDITIONS FOR 70/90KM

  1. Please make sure you communicate all of the instructions and directions provided to you for this Event to your team members.
  2. Riders are required to attend a compulsory safety briefing at the start line, Esplanade Reserve, Fremantle at 5.40am.
  3. If you have entered as a team, please ensure that you rally your team members together and to ride as a team. We will be reminding team captains that the Bunch Ride formation for teams is recommended. As there are a limited number of riders per team – we recommend the Pace Line (single file) method of bunch riding for this event.
  4. To ensure SAFETY and PREVENTION of accidents – the Safety Vehicle will NOT be permitted to travel more than 25km/h through Fremantle City to the corner of Tydeman Road and Port Beach Road.
  5. MSWA Ocean Ride is NOT a race and we expect all riders to remember the charitable intention of this event to ensure that everyone finishes safely.
  6. Riders are required to keep a minimum distance of around 100 metres from the lead Safety Pace Vehicle. Participants that ride past the Safety Pace Vehicle will be removed from the course.
  7. Once outside of Fremantle – the Safety Pace Vehicle will travel at speeds dependent on the road traffic rules or slower to ensure that this remains a community event.
  8. The Safety Pace Vehicle is in communication with the Event organisers who are in turn communicating with traffic management, Main Roads and Police. They may at times be required to slow down the field for safety reasons. The field will then be ‘neutralised’ and riders will be asked to ride slow until the OK is given for the speed to increase.
  9. The Safety Pace Vehicle will travel up front with the first riders from the start to the finish at Whitfords Nodes, Hillarys. The Safety Pace Vehicle will enter through the end gantry in front of the teams.
  10. First aid staff will be located along the course.
  11. Participants are to follow the directional signs and marshalling throughout the route. Traffic signals are being timed in some locations to minimise any stops along the way but all riders are to remember that the route is for many parts an open circuit and as such ALL riders MUST adhere and follow the normal WA Road Rules and Regulations.
  12. Caution – please note that for the ascent of Reabold Hill to be mindful of descending cyclists. At the top of Reabold Hill we have a classic ‘hotdog’ turn and it can be congested. This means that riders need to approach the ascent with caution before turning and heading down the Hill. Please be mindful of your descent and hold your line with no weaving as there will be ascending cyclists.
  13. Stopping along the ascent, at the top of Reabold Hill and on the descent is NOT permitted for safety reasons.
  14. Participants are reminded to hydrate well throughout the ride and also to ensure that they have sufficient food to consume before and during the event.
  15. We encourage high visibility and as such the use of front and rear lights throughout the route is highly desirable. Please do not place your lights on strobe phase but on continuous phase so you will not distract other bike riders behind you.
